Gewinnspiel „MANDOKI SOULMATES“ anlässlich HIGH END München vom 11. – 12.05.2024

Der Veranstalter des Gewinnspiels ist RED ROCK PRODUCTION, Deutschland (im Folgenden: „Veranstalter“).
Mit der Teilnahme an diesem Gewinnspiel akzeptieren die Teilnehmenden die folgenden Teilnahmebedingungen, die die Teilnahme und Abwicklung des Gewinnspiels abschließend regeln:
§ 1 Teilnahmeberechtigung
Teilnahmeberechtigt sind alle natürlichen Personen mit ständigem Wohnsitz in der Europäischen Union, die zum Zeitpunkt der Teilnahme das 14. Lebensjahr vollendet haben. Nicht teilnahmeberechtigt sind Mitarbeitende von Red Rock Production und der HIGH END SOCIETY sowie deren Angehörige im Sinne des § 15 der Abgabenordnung.
Die Teilnahme am Gewinnspiel ist pro Person nur einmal möglich. Eine mehrmalige Teilnahme kann dazu führen, dass der Teilnehmende vom Gewinnspiel ausgeschlossen wird.
§ 2 Teilnahme und Durchführung des Gewinnspiels
1. Die Teilnahme an dem Gewinnspiel ist bei gleichen Gewinnchanen über den Einwurf der Teilnehmerkarten in die Losboxen während der HIGH END München 2024 in München am 11. bis 12.05.2024 möglich. Die Teilnahme ist NUR mit der Original-Teilnahmekarte möglich. Um an der Verlosung teilzunehmen, muss der Teilnehmende eine Gewinnspielkarte auf der Messe ausfüllen. Die Teilnahme setzt voraus, dass der Teilnehmende die geforderten Angaben (Name, Straße, PLZ/Ort, E-Mail-Adresse) vollständig auf der Teilnahmekarte einträgt, durch die Teilnahme am Gewinnspiel in die Verarbeitung seiner personenbezogenen Daten zur Durchführung des Gewinnspiels einwilligt und die Teilnahmekarte während der HIGH END München im MOC, Lilienthalallee 40, 80939 München, in die aufgestellte Gewinnspielbox auf dem Stand der Mandoki Soulmates auf dem Messegelände einwirft.
2. Die Teilnahme an der Verlosung setzt nicht den Kauf einer Ware oder Dienstleistung voraus.
3. Das Gewinnspiel beginnt am 11.05.2024 und endet am 12.05.2024, um 15:00 Uhr MEZ.
4. Unter allen Teilnehmenden, die die Voraussetzungen dieser Teilnahmebedingungen erfüllen, wird als erster Preis der Besuch von 1 x 2 Personen des Red-Rock-Production-Studios in Tutzingen, Deutschland, einschließlich Meet & Greet mit Leslie Mandoki, als zweiter Preis 3 x 2 Konzerttickets für das Mandoki Soulmates Konzert am 15.08.2024 in München und als dritter Preis x Mandoki-Soulmates-Alben „A Memory Of Our Future” verlost. Sämtliche Reisekosten zum Red-Rock-Production-Studio oder zum Konzert nach München tragen die Gewinner.
Die Gewinner und Gewinnerinnen werden am 12.05.2024 per Losverfahren unter allen Teilnehmenden ermittelt, die ordnungsgemäß nach § 1 und § 2 dieser Teilnahmebedingungen an dem Gewinnspiel teilgenommen haben.
Die Preise sind nicht übertragbar und können nicht umgetauscht werden. Eine Auszahlung des jeweiligen Preises in bar oder ein Anspruch auf Schadensersatz ist nicht möglich.
5. Die Teilnahme am Gewinnspiel ist kostenlos.
§ 3 Gewinnbenachrichtigung und Übergabe der Gewinne:
1. Red Rock Production informiert die Gewinner per E-Mail/Post an die im Rahmen des Gewinnspiels angegebene E-Mail-Adresse/ Postanschrift über ihren Gewinn. Sollte die Gewinnbenachrichtigung per E-Mail/Post nicht zustellbar sein oder sollte sich ein Gewinner/Gewinnerin nicht innerhalb von vier Wochen nach der Versendung der Gewinnbenachrichtigung bei Red Rock Production melden, so ist Red Rock Production nicht dazu verpflichtet, weitere Nachforschungen zu betreiben. In diesem Fall verfällt der Anspruch des Gewinners auf den Gewinn und ein neuer wird von Red Rock Production per Losverfahren ermittelt.
2. Meldet sich der Gewinner/Gewinnerin innerhalb von vier Wochen nach der Versendung der Gewinnbenachrichtigung bei Red Rock Production, wird mit dem Gewinner/Gewinnerin die Einlösung des Gewinns vereinbart. Für den ersten Preis wird ein Besuch im Red Rock Production Studio, Tutzing, inklusive Meet & Greet mit Leslie Mandoki in 2024 verabredet. Der zweite und dritte Preis wird an eine vom Gewinner/Gewinnerin angegebene Postadresse innerhalb der Europäischen Union kostenfrei per Spediteur oder Paketdienst ausgeliefert. Ist der erste Lieferungsversuch des Gewinns durch ein Verschulden des Gewinners nicht erfolgreich, werden die Kosten für eine weitere Lieferung nicht von Red Rock Production übernommen. In diesem Fall stellt Red Rock Production den Gewinn am Sitz von Red Rock Production in Tutzing zur Abholung vier Wochen bereit. Holt der Gewinner/Gewinnerin den Gewinn innerhalb dieser Zeit nicht ab, verfällt der Anspruch des Gewinners auf den Gewinn und ein neuer Gewinner/Gewinnerin wird von Red Rock Production per Losverfahren ermittelt.
3. Kosten, die im Rahmen der Teilnahme am Gewinnspiel anfallen können, wie beispielsweise die Reisekosten zum Besuch bei Red Rock Production in Tutzing oder zum Besuch des Mandoki Soulmates Konzerts in München, die über die vorgenannten beschriebenen Leistungen von Red Rock Production hinausgehen, sind nicht in den Gewinnen enthalten und sind von den Teilnehmenden zu tragen.
§ 4 Ausschluss von der Teilnahme am Gewinnspiel
Die Teilnahme über Gewinnspielclubs oder andere kommerzielle Dienstleister ist ausgeschlossen. Bei Verstößen gegen diese Teilnahmebedingungen behält sich die Mandoki Soulmates das Recht vor, Personen von der Verlosung auszuschließen, ggf. können Gewinne auch nachträglich entzogen und/oder zurückgefordert werden.
Red Rock Production behält sich das Recht vor, die Teilnehmenden, die falsche Angaben im Rahmen der Gewinnspielteilnahme gemacht haben, die gegen die Teilnahmebedingungen verstoßen, die Manipulationen vornehmen oder vornehmen lassen, vom Gewinnspiel auszuschließen.
Widerruft oder widerspricht ein Teilnehmender der Verwendung seiner personenbezogenen Daten zur Durchführung des Gewinnspiels, erfolgt der Ausschluss dieses Teilnehmenden vom Gewinnspiel, da in diesem Fall eine Teilnahme am Gewinnspiel nicht mehr möglich ist. In diesen Fällen behält sich Red Rock Production das Recht vor, die Übergabe bereits zugesagter Gewinne zu verweigern, wenn eine Übersendung der Gewinne aufgrund fehlender personenbezogener Daten nicht mehr möglich ist.
Teilnehmende, die die Teilnahmekarten nicht vollständig ausfüllen, nicht die Teilnahmebedingungen des Gewinnspiels akzeptieren oder nicht in die Verwendung ihrer personenbezogenen Daten einwilligen, werden von der Teilnahme am Gewinnspiel ausgeschlossen.
§ 5 Beendigung des Gewinnspiels
Der Veranstalter behält sich das Recht vor, das Gewinnspiel aus wichtigem Grund jederzeit ohne Vorankündigung abzubrechen. Im Falle einer Absage der Initiative aus wichtigem Grund wird der Veranstalter die Teilnehmenden unverzüglich informieren. Eine Absage aus wichtigem Grund kann insbesondere dann erfolgen, wenn eine ordnungsgemäße Durchführung des Gewinnspiels nicht mehr gewährleistet werden kann. In diesen Fällen übernimmt der Veranstalter keine Haftung für entgangene Teilnahmechancen.
§ 6 Haftungsbeschränkung
Der Veranstalter übernimmt keine Haftung für die folgenden Situationen:
- unrichtige oder ungenaue Angaben der Teilnehmenden infolge von nicht lesbaren oder falschen Angaben;
- Eingriffe von Unbefugten in den Teilnahmeprozess oder die Verlosung; oder
- verspätete, unvollständige, beschädigte oder gestohlene Anträge. Wird bestätigt, dass die Anmeldung eines Teilnehmers aus irgendeinem Grund verloren gegangen oder zerstört oder auf andere Weise beschädigt wurde, kann der Teilnehmer nur durch eine erneute Teilnahme an der Verlosung Abhilfe schaffen, sofern dies vor dem Enddatum geschieht.
Im Übrigen ist der Veranstalter nur zum Schadensersatz verpflichtet, wenn der Schaden auf Vorsatz oder grobe Fahrlässigkeit zurückzuführen ist.
Darüber hinaus haftet der Veranstalter auch für die einfach fahrlässige Verletzung einer wesentlichen Pflicht. Wesentliche Pflichten sind solche, deren Erfüllung die ordnungsgemäße Durchführung des Gewinnspiels und die Erreichung des Vertragszwecks überhaupt erst ermöglicht und auf deren Einhaltung ein Teilnehmer des Gewinnspiels regelmäßig vertrauen darf. Die Haftung nach dem Produkthaftungsgesetz bleibt hiervon unberührt.
§ 7 Datenschutz
Personenbezogene Daten (Name, Vorname, Straße, Hausnummer, Postleitzahl, Ort, Land, E-Mail-Adresse) der Teilnehmenden werden ausschließlich zum Zweck der Durchführung des Gewinnspiels gespeichert. Diese personenbezogenen Daten werden zur eindeutigen Identifizierung der Teilnehmenden, zur Benachrichtigung der Gewinner und zur Bekanntgabe der Gewinner verwendet.
Der Veranstalter ist verpflichtet, die personenbezogenen Daten der Teilnehmer nach den Vorgaben des Bundesdatenschutzgesetzes zu schützen und nur zum Zweck der Durchführung des Gewinnspiels zu verwenden. Rechtsgrundlage für die Datenverarbeitung ist Art. 6 Abs.1 Satz 1 lit. b DSGVO.
Die Teilnehmer haben jederzeit ein Recht auf unentgeltliche Auskunft über ihre personenbezogenen Daten, die der Veranstalter über sie gespeichert hat, sowie ein Recht auf Berichtigung, Löschung oder Sperrung dieser personenbezogenen Daten. Entsprechende Anfragen muss der Teilnehmende an die unten angegebene Kontaktadresse senden.
Die Teilnehmer können jederzeit ihre Zustimmung zur Verwendung ihrer personenbezogenen Daten für die Zukunft widerrufen. Der Teilnehmer muss diesen Widerspruch einreichen bei:

Der Teilnehmer erklärt sich mit der Speicherung, Nutzung und Verarbeitung der personenbezogenen Daten zu dem angegebenen Zweck einverstanden.
§ 8 Anwendbares Recht
Ein Rechtsmittel ist nicht zulässig. Es gilt ausschließlich das Recht der Bundesrepublik Deutschland.
§ 9 Allgemeine Hinweise
Sollten einzelne Bestimmungen dieser Teilnahmebedingungen ganz oder teilweise unwirksam sein, so wird dadurch die Wirksamkeit der übrigen Bestimmungen nicht berührt.
Diese Teilnahmebedingungen können vom Veranstalter jederzeit ohne gesonderte Mitteilung geändert oder ergänzt werden, wenn dies im Interesse einer einfachen und sicheren Abwicklung, insbesondere zur Verhinderung von Missbrauch oder aus sonstigen Gründen erforderlich ist.

Conditions of participation for the „MANDOKI SOULMATES“ prize draw on the occasion of HIGH END Munich from 11 – 12.05.2024
The Organizer of the draw is RED ROCK STUDIO, Germany (hereinafter: “Organizer”).
By participating in this prize draw, the participants accept the following conditions of participation, which definitely govern the participation and handling of the prize draw:
§ 1 Eligibility
All natural persons with a permanent residence in the European Union who have reached the age of 14 at the time of participation are eligible to participate. Ineligible to participate are employees of Red Rock Studio and HIGH END SOCIETY as well as their relatives within the meaning of Section 15 of the German Fiscal Code and spouses.
Participation in the prize draw is only possible once per person. Multiple entries may result in the participant being excluded from the prize draw.
§ 2 Participation and implementation of the prize draw
1. Participation in the prize draw is possible with equal chances of winning by dropping the participation cards into the raffle boxes during the HIGH END Munich 2024 in Munich on May 11-12, 2024. Participation is ONLY possible with the original entry card.
To participate the prize draw, the participant must fill out a prize draw card at the HIGH END Munich. Participation requires that the participant enters the required details (name, street, postcode/city, e-mail address) in full on the entry card, consents to the processing of his/her personal data for the purpose of the prize draw by participating in the prize draw and deposits the entry card in the prize draw box set up Mandoki Soulmates booth at the MOC, Lilienthalallee 40, 80939 Munich, during the HIGH END Munich.
2. Participation in the prize draw does not require the purchase of a product.
3. The prize draw will start on May 11 and end on May 12 at 3:00 pm CET.
4. All participants who fulfil the requirements of these conditions of participation will be entered into a prize draw to win as first prize a visit for 1 x 2 people to the Red Rock Production Studio in Tutzingen, Germany, including a meet & greet with Leslie Mandoki, the second prize is 3 x 2 concert tickets for the concert of Mandoki Soulmates on August 15, 2024 in Munich and the third prize is x Mandoki Soulmates albums “A Memory Of Our Future”. All travel costs to the Red Rock Production studio or the concert in Munich will be borne by the winners.
The winner will be picked at random on May 12, 2024 from all participants who have duly entered the prize draw in accordance with § 1 and § 2 of these conditions of participation.
The prizes are non-transferable and cannot be exchanged. Payment of the respective prize in cash or any claims for compensation are not possible.
5. Participation in the prize draw is free.
§ 3 Notification of winnings and handover of winnings
1. Red Rock Production will inform the winners of their prize exclusively by e-mail to the e-mail address/postal address provided in the context of the prize draw. If the prize notification cannot be delivered by e-mail/post or if a winner does not contact Red Rock Production within four weeks of the prize notification being sent, Red Rock Production is not obliged to make any further inquiries. In this case, the winner’s claim to the prize is forfeited and a new winner will be picked at random by Red Rock Production.
2. If the winner contacts Red Rock Production within four weeks of the prize notification being sent out, Red Rock Production will make arrangements with the winner to redeem the prize. For the first prize, a joint appointment will be arranged at the Red Rock Production studio in 2024. The second and third prizes will be delivered to a postal address specified by the winner within the European Union free of charge by carrier or parcel service. If the first attempt to deliver the prize is unsuccessful due to the winner’s fault, Red Rock Production will not bear the costs of further delivery. In this case, Red Rock Production will make the prize available for collection at Red Rock Production’s headquarters in Tutzing, Germany, for four weeks. If the winner does not collect the prize within this period, the prize will be forfeited and a new winner will be selected by Red Rock Production by random.
3. Costs that may be incurred in connection with participation in the prize draw, such as travel costs to visit Red Rock Production in Tutzing or to attend the concert of Mandoki Soulmates in Munich, which go beyond the services of Red Rock Production described above, are not included in the prizes and are to be borne by the participants.
§ 4 Exclusion from participation in the prize draw
Participation through prize draw clubs or other commercial service providers is excluded. If these conditions of participation are breached, Red Rock Productions reserves the right to exclude people from the draw, and prizes can also be subsequently withdrawn and/or reclaimed if necessary.
Red Rock Production reserves the right to exclude participants from the price draw who have provided false information in the context of participation in the prize draw, who violate the conditions of participation, who carry out manipulations or have them carried out.
If a participant revokes or objects to the use of their personal data for the purposes of the prize draw, this participant will be excluded from the prize draw, as in this case participation in the prize draw is no longer possible. In these cases, Red Rock Production reserves the right to refuse to hand over prizes that have already been promised if it is no longer possible to send the prizes due to missing personal data.
Participants who do not complete the entry forms in full, do not accept the terms and conditions of the prize draw or do not consent to the use of their personal data will be excluded from the prize draw.
§ 5 Termination of the prize draw
The Organizer reserves the right to cancel the prize draw for good reason at any time without giving prior notice. In the event that the initiative is cancelled for good reason, the Organizer will inform the participants immediately. Cancellation for good reason may take place if for technical reasons proper implementation of the initiative can no longer be guaranteed. In these cases, the Organizer accepts no liability for lost chances to participate.
§ 6 Limitation of liability
The Organizer accepts no liability for the following situations:
- incorrect or inaccurate information provided by participants because of illegible or incorrect information;
- interference by unauthorized parties in the participation process or the draw; or
- late or delayed, incomplete, lost, damaged or stolen applications. If it is confirmed that the application of a participant has been lost or destroyed or damaged in any other way, the only remedy available to the participant is renewed participation in the draw if this is done before the end date.
Apart from this, the Organizer shall only be obliged to pay compensation if the damage can be attributed to willful intent or gross negligence.
In addition, the Organizer is also liable for just the simply negligent breach of an essential obligation. Essential obligations are those whose fulfilment make it possible to properly implement the prize draw and achieve the purpose of the contract and which a participant in the prize draw can ordinarily rely on being complied with. The liability under the German Product Liability Act remains unaffected.
§ 7 Privacy
Personal data (last name, first name, street, house number, postcode, city, country, e-mail address) of the participants is stored exclusively for the purpose of implementing the prize draw. This personal data shall be used to clearly identify the participants, to notify the winners and to announce the winners.
The Organizer is obliged to protect the personal data of the participants in accordance with the specifications of the German Data Protection Act and to utilize this data only for the purpose of implementing the prize draw. The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. b GDPR.
The participants have at any time the right to request, free of charge, information about their personal data which the Organizer has stored about them, and at any time the right to have this personal data corrected, deleted, or blocked. The participant must send corresponding requests to the contact address which is shown below.
The participants may at any time withdraw their consent to their personal data being used for the future. The participant must submit this opposition to:

The participant agrees to the storage, use and processing of the personal data which is communicated for the stated purpose.
§ 8 Applicable law
There is no right of appeal. Exclusively the law of the Federal Republic of Germany is applicable.
§ 9 General information
If individual provisions in these conditions of participation should be ineffective in whole or in part, this shall not affect the effectiveness of the rest of the provisions.
These conditions of participation may be amended or supplemented by the Organizer at any time without separate notification if this is required in the interest of ensuring simple and secure processing and in particular for the purpose of preventing misuse or for other reasons.
